Assault Charges

Assault in Michigan is an attempt to cause physical injury to another person. Battery Charges

In contrast, assault or battery committed without a dangerous weapon can lead to a misdemeanor case. If the result is a serious injury, it’s considered an aggravated assault and battery, which is punishable by more jail time.

Punishment for Assault and Battery

A person convicted of a simple assault can face the following penalties:

  • Up to 93 days in jail, a fine up to $500, or both
  • Probation (up to two years) and restitution

A person convicted of aggravated assault and battery may face the following penalties:

  • Up to one year in jail, with a fine up to $1000, or both
  • Probation (up to two years) and restitution

If the defendant has any prior conviction for assault or assault and battery of any kind, the charge may be classified as a felony and the court can sentence the defendant to up to two years in prison, a fine up to $5,000, or probation up to five years.
