Assault Charges
Assault in Michigan is an attempt to cause physical injury to another person. Also, any intentional unlawful act or threat, even if that’s raising a wrist or brandishing a weapon, is a form of assault. If the offender seems to have the ability to actually carry out the treat of action and causing others to feel afraid of impending violence, that is also an act of assault.
Battery Charges
In contrast, assault or battery committed without a dangerous weapon can lead to a misdemeanor case. If the result is a serious injury, it’s considered an aggravated assault and battery, which is punishable by more jail time.
Punishment for Assault and Battery
A person convicted of a simple assault can face the following penalties:
- Up to 93 days in jail, a fine up to $500, or both
- Probation (up to two years) and restitution
A person convicted of aggravated assault and battery may face the following penalties:
- Up to one year in jail, with a fine up to $1000, or both
- Probation (up to two years) and restitution
If the defendant has any prior conviction for assault or assault and battery of any kind, the charge may be classified as a felony and the court can sentence the defendant to up to two years in prison, a fine up to $5,000, or probation up to five years.
